Within these terms and conditions “Charlotte Bussing Ltd “is “The Company “.

The “ Hirer “relates to any persons, company, group, individual or any person who negotiates to or for persons, or hires a vehicle for or on behalf of persons from Charlotte Bussing Ltd.

TERMS AND CONDITIONS

The Terms and Conditions apply to any hire between Charlotte Bussing Ltd and the Hirer. A contract is an agreement between 2 people called the parties meaning Charlotte Bussing Ltd and the hirer and will be legally binding providing that an offer has been given, acceptance has been agreed, and consideration has been agreed.

These terms and conditions apply to any hire between Charlotte Bussing Ltd and the hirer whether the contract is in writing. Oral, or a combination of the two, and wherever or whenever a contract is made.

QUOTATIONS

All quotations and hire costs will be given in writing, and based on information provided by the hirer. Should Charlotte Bussing Ltd be notified in writing of alterations, or provided with new information after a quote has bee provided then Charlotte Bussing Ltd have the right to alter the price quoted. Quotations are based on the most direct route and at the discretion of Charlotte Bussing Ltd except where a specific route is communicated in writing between the hirer and Charlotte Bussing Ltd, and that added costs are agreed between the hirer and Charlotte Bussing Ltd. Quotations show a daily cost, this covers the cost of the hire of a vehicle, fuel, and driver. All other costs such as ferries, expenses, tolls, coach parking fees, parking tickets, meals etc are additional to the daily cost of hire. All quotations are valid for 28 days. Charlotte Bussing Ltd will not be bound by quotes that are not accepted within the time scale of 28 days of issue.

PAYMENT

Payment terms to Charlotte Bussing are as follows; a deposit of an agreed figure is required to secure the booking. The balance must to be paid before the end of the tour. Arrangements to pay by instalments may be made between Charlotte Bussing Ltd and the hirer prior to the date of commencement of the booking.

CANCELLATION

Should the hirer cancel before a deposit has been paid then no monies are required, once a deposit is paid and the hirer cancels, then the deposit becomes non-refundable. 50% of the amount due becomes payable if the hirer cancels the booking up to two weeks prior to commencement. 100% becomes payable should the hirer cancel the booking one week or less prior to the date of commencement. Cancellation during a booking requires full payment to be made upon cancellation if payment has not been fulfilled.

Charlotte Bussing Ltd may cancel the contract of hire should any emergency arise that Charlotte Bussing Ltd have no control over, such as strikes, adverse weather or road conditions which make it impossible for Charlotte Bussing Ltd to perform the contract of hire. In such circumstances Charlotte Bussing Ltd may return monies paid by the hirer (less the cost of the vehicle hire to the date of cancellation). Charlotte Bussing Ltd shall also reserve the right to cancel the booking if funds owed are not paid within the arranged time scale between Charlotte Bussing Ltd and the hirer, cancellation pursuant to this is without prejudice.

Charlotte Bussing Ltd, shall not be held responsible, should any failure to perform the booking through events beyond there control by reason of accident, fire, traffic congestion, vehicle breakdown or strikes or any other reasonable control (a “force majeure event”). Though Charlotte Bussing Ltd shall make every effort to maintain the service contracted for.

DRIVER HOURS AND EU REGULATIONS

We at Charlotte Bussing Ltd adhere to the EU Regulations for driving hours and rest periods and these must be adhered too, (EU driving hours and rest periods change in April 2007). No hirer must instruct the driver to break the current regulations regarding driver’s hours and rest periods.

INSURANCE OF PERSONAL EFFECTS AND BACKLINE

Hirers and passengers must have adequate insurance for all personal effects, equipment and instruments whether on the vehicle or in a trailer this insurance is known as Goods in Transit insurance. Charlotte Bussing Ltd will not accept responsibility for any personal items or equipment and instruments that are on the vehicle or in a trailer whether attached or detached from the vehicle, unless there is cause for negligence by the company or its drivers. Charlotte Bussing Ltd will not be held responsible for the theft of any items due to the negligence of any passengers failing to lock the doors when they have been provided with a key, or by allowing strangers onto the vehicle. The hirer is highly encouraged to take out suitable insurance to protect your tour budget, for instance to cover costs of hotels if the vehicle has a mechanical failure and no substitute vehicles are available.

HIRE OF VEHICLE AND TRAILER

The hirer must insure all equipment, which is carried in a trailer hired from Charlotte Bussing Ltd. All trailers are serviced regularly. Breakdown of trailers cannot be guaranteed and any onward transportation will not be the responsibility of Charlotte Bussing Ltd but all efforts will be made to rectify the problem. The hirer accepts that it is there responsibility to ensure no damage is done to the vehicle or trailer by a third party whilst parked at any venue, the hirer will be responsibility to pay for any damage incurred. Damage by passengers travelling on the vehicle also becomes chargeable. If a trailer has been hired then the hirer must be responsible for all documentation relating to its contents (carnet etc).

BREAKDOWNS AND DELAYS

Charlotte Bussing Ltd shall not be held responsible for any failure to arrive at a venue where circumstances arise that are beyond our control. Should a breakdown happen then all possible action should be taken to get all hirers to the venue at the appointed time. The hirer, should taken extra insurance as a safe guard, should they not reach the venue due to excruciating circumstances beyond the control of Charlotte Bussing Ltd.

NOTICES

Any contract for hire of the companies vehicle is made in England, any communication in writing between Charlotte Bussing Ltd and the hirer is valid for the purposes of complying with these terms and conditions. Any litigation arising out of the interpretation and performance of any Contract of any hire will be brought in the courts of England and Wales.

ROUTE, FUEL AND TIME VARIATIONS.

The company reserves the right to levy additional charges for additional mileage or time to that agreed. The charges will be pro rata and in accordance to the rates on the booking form. Charlotte Bussing Ltd reserve the right to increase the fuel element of our charges at any time should the price of fuel increase to us by 8% or more from that prevailing at the time the booking is confirmed.
